Public officers losing their cool says Daly

President of the Law Association Martin Daly, SC, said yesterday that people in responsible public office were losing their cool in the face of reasoned comment which they do not like. Daly’s comments come one day after Attorney General John Jeremie used the budget debate in the Senate to severely criticise him over comments made surrounding the affidavit filed in court by Jamaat al Muslimeen leader Yasin Abu Bakr in which an allegation was made by Bakr that he had struck a deal with Prime Minister Patrick Manning, prior to the 2002 general elections. Not only did Jeremie use the budget debate to blast the Law Association, but he walked with a prepared speech for the occasion. In his contribution Jeremie accused Daly of speaking “a lie” in his criticism of retired Justice of Appeal Jean Permanand, a member of the Judicial and Legal Service Commission.

Daly, who is currently out of the country said, “It came to my attention through reading the newspapers on the Internet that the Attorney General had ‘called me out’ in Parliament yesterday (Wednesday) in connection with the performance of my duties as President of the Law Association of Trinidad and Tobago, presumably relying on the cover of parliamentary privilege.” Daly said he did not have a copy of Hansard, neither had he received a letter from the Attorney General or the legal opinions on which Jeremie relies, concerning the admissibility of the affidavit. He promised to respond when he receives these documents. He said, “My first impression drawn from the reports I have read is that those in responsible public office are losing their cool in the face of reasoned comment which they do not like.”

Daly in a column last Sunday said, “the subject is hatred and intolerance of competing views, and it may be usefully read in light of the Attorney General’s behaviour in Parliament. He said, “I will not of course descend into personal attack, but I look forward to engaging further on the important issue of the political executive’s treatment of the judiciary and the law offices of the State.” On September 11, Justice Rajendra Narine, ordered that 11 properties owned by Bakr and senior Jamaat member Kala Akii Bua be put up for public auction to satisfy a $40 million debt to the State for the destruction of Police Headquarters during the 1990 attempted coup. In his judgment, Narine directed that Bakr’s affidavit be sent to the acting Commissioner of Police and the acting Director of Public Prosecutions for investigations.

This was done despite the fact that both the Court of Appeal and the Privy Council struck out the affidavit from the summons for sale motion. On September 14, Jeremie responded in the House of Representatives criticising the judge for sending the affidavit for investigations. Permanand went on television and said what Narine did was wrong. Daly, through the Law Association, responded, condemning both Jeremie and Permanand, saying that Narine was perfectly correct in sending the affidavit for investigation, although it was struck out as part of Bakr’s defence.

Just last week they did the same with the CJ and the AG; one was showing a beaming, personable, gleeful, confident and charismatic CJ and the other a dour, sour, plotting, scheming CJ. KLEPTOCRACY is defined as government that steals from the people.
Please stop referring to Trinidad & Tobago as a democracy or a republic. If it were a true democracy or a republic then the people would have a say in how the country is governed.
Think of this: 5 men have run TnT since independance in 1962. In the US there has been 10 different presidents, in England 10 different prime ministers, and in Canada 9 different prime ministers. Yet we in TnT like Prime Ministers for life.

For the past quarter

For the past quarter century, in both democratic and non-democratic states, individuals who have acknowledge participating in terrorist activities have been subject to two course of actions, specifically death or substantial jail terms. That Trinidad and Tobago is an exception to this rule, can only lead to one common sense conclusion, that being: that governments past and present in all likelihood have been in bed with the terrorist.

Mr. Daly, Sir, The Speaker of the House has a responsibility to keep order among our parliamentarians. If and when anyone of them, no matter their political affiliations or station, elects to use unsavoury language, it is his duty to call them into question. Using language to discredit you with terms such as 'you Lie' is not acceptable.

Also, we do not believe that an 'intelligent' high ranking government official should be allowed to indulge in character assassination in our Parliament.

In the past week a politician yelled at the U.S. President during his speech, "You lie", and had to apologise, which he did to Mr. Obama; but this was not satisfactory as the Senate called upon him to do so in the appropriate setting.

We cannot continue to tolerate this type of hooligan/barbaric behaviour coming from our employees in government.

If Mr. Jeremie took objections to your comments, he has the freedom, in this our democracy, to criticise what you said; but we cannot accept the manner in which he behaved.

This entire issue of the Affidavit and the alleged deal with the P.M. is very disturbing to the people of this country. And we expect civilised discourse to take place in adressing this matter.

We need to bring back DECORUM into our Parliament! It apparently 'flew the coop'.

The people, especially the impressionable children are listening and learning.

All public Servants are stressed out at some point in having their work done. I have been a victim of such during my tenure in the Ministries Health & National Security. That does not give the law Association head to make such statements.

In general comments coming from a lot of legal minds, and baby boomers like my self are bias period because they take one side of the fence and not the other, and missing the the overall picture of the issues that plague the Trinidad & Tobago society.

You can play a strategic middle game or wait for the endgame. But remember, they have the advantage of a greater number of 'minor pieces' in Parliament. I'm waiting to see who'll be checkmated first. Or maybe, it could turn out to be a stalemate?
