Panday loses bias claim
Basdeo Panday, political leader of the United National Congress (UNC), has lost another court battle. Yesterday, Justice Vasheist Kokaram, presiding in the Port-of-Spain High Court, dismissed Panday’s judicial review matter, in which he had claimed that there was a perception that Magistrate Ejenny Espinet could be bias against him in his corruption case. But Kokaram said Panday had brought nothing to court to show a well-informed observer would conclude that because Espinet’s father was a former PNM Government Minister, she would not act fairly when she came to judge his case, which has been before her for years. Panday was represented by British Queen’s Counsel, Geoffrey Robertson, while Douglas Mendes SC and Ian Benjamin, appeared for Espinet.
Kokaram adjourned the issue of costs for Tuesday, when Robertson would be in Trinidad for an extradition appeal involving Ishwar Galbaransingh and Steve Ferguson. Yesterday’s loss was another in a string of legal defeats for the UNC leader in recent years, including his failure to block a retrial on charges of him failing to declare his London Natwest account to the Integrity Commission from 1997 to 1999. In his claim, Panday contended that Espinet’s father, Alexander Chamberlain Alexis, was a former PNM Minister in the Government of Dr Eric Williams. He also contended that Espinet was a trustee and treasurer of the Morris Marshall Foundation in Laventille, which organisation, he claimed, was aligned to the ruling PNM party. Panday submitted that the well-informed observer must step back and take these facts cumulatively to determine whether there was apparent bias.
He further submitted that “the blood of the PNM courses through the veins of the magistrate.” In his oral judgment yesterday, Kokaram said the well-informed observer would digest the fact that Panday would say that the charges were politically motivated. But the observer, according to the judge, would want to know how it was that that magistrate was enjoined in a political battle against Panday. “How is this magistrate, given her associations as we now know, unable to professionally judge the committal proceedings impartially? The web of links is tenuous,” Kokaram said. He added: “Here, the balance between confidence in the Judiciary and the perception of a fair trial will meet its waterloo, if the well-informed observer is hasty in his deliberations.
“A civilised society must not be quick to draw irrational or hasty conclusions. Restraint rather than swift condemnation is the hallmark of mature deliberation,” he added. Panday, the Leader of the Opposition, and his wife Oma, are charged with accepting a bribe of 25,000 pounds sterling from businessmen, Ishwar Galbaransingh and Carlos John. Ravi Rajcoomar, who appeared for Panday, yesterday hinted at his client appealing the judgement He said his client also would seek a stay pending the outcome of the appeal. The preliminary inquiry before Espinet is not expected to come up before next January.

All the more reason for Panday to take a back seat in "his" UNC and concentrate on his legal battles. There is little doubt that Panday has been singled out for political persecution while many others have escaped. But when you are in high office of trust you must be like Caesar's wife, you must be above suspicion.
Recent decisions by magistrates who have used questionable technicalities to the advantage of the defendants do not create a perception of confidence in the magistracy, but if decisions at this preliminary stage in the justice system are flawed, there are avenues for redress through appeals.
Having been charged, it is in the interest of Panday, his Party and the country for these matters to be settled expeditiously. If he is innocent, he will be cleared of the charges. In the meanwhile, they rest around his neck, the UNC and the country like albatrosses.

While I don't wish to indulge in semantics or hairsplitting, it seems that what I had to say might have been misconstrued.
In the first place I am quoted in inverted commas as using the words "no doubt" when I wrote "little doubt". Granted there is only a nuance between the two, but quotations should be at least faithful.
In the second place my statement was described as "histronic". I take it this was a typographical error and the word intended for use was "histrionic" which I believe means theatrical or emotionally exaggerated. This certainly was not my mental outlook or my intention at the time of writing.

As much as we may have opinions, done our calculations, analyse, assess and reasses, etc. we have to leave that door open for the Official and Final Judgement to come from the Justice System.
If according to you "he is guilty as charged" and we wish to throw the books on him, then we can attempt to do so; but no legal doors will be left opened for those of us who wish to take this journey.
But need I remind you that we do operate in a democracy and while public opinions do matter, they have no place in our Justice System. We have opnions and this platform gives us the privilege to submit ours, and we do so without dumping on others. Isn't life great, especially when we have our freedoms like we do in T&T.
I am sure you are aware of many cases in rhe Americas where many who have been sentenced by the Justice System, served time in jail, some more than 20 years, have finally been given their freedoms when it was found that they were 'innocent' people who were served wrongly by the courts.
So I for one will leave that Final Decision to come from the Justice System, and not from me or anyone else who may think that "he is guilty as charged".

J Lindsay, you starting to get a real grip on the real reason why Panday fighting so hard to stay as leader of the UNC. Even if it means having the electorate so disenchanted with the alternative to the point where they go and put back the PNM, Panday's sole mission in life right now is to find a way to stay out of prison. But if he feel being Leader of the Ppposition is so prestigious that he is above being jailed after being found guilty, he need to start getting used to cold showers and liquid soap (yuh cyar drop dat).

Because as I see it, the more devisiveness there is within the "oppositions", the more likely that the PNM will keep their strangle hold on governance of the country. But people will always "go with the horse" they know rather than one with a jockey that looks like he has one foot in the grave and the other foot in the jail house. So with that scenario, it will mean PNM in power for the foreseeable future. What a shame!

Doing what is in the best interest of the country is not in the cards for Panday. He will make his own decisions and claim it is what "the people who put him in office" want, in other words, his party's executive who keeping him in office. The main purpose of the executive is to ensure the greater good of the party in an effort to gain power in the general elections and offer the country better governance. It is clear the main function of this executive is to keep Oma Panday (and Bas as well) as the head of this club. If Panday listened to the people he would have been gone 2 years ago and his memoires would have been a best seller (a good offset to pay his legal fees). So unless people wise up and see the urgency of the situation, they would run reluctantly back to the PNM and is another 5 years of Manning. A scenario that Panday's sycophants should hardly complain about, since they have Panday staying where he is causing people to vote against the opposition instead of for it. So you are quite correct to say that Manning could afford to make brazen statements... he has no reason to fear losing office.

That is his strategy - except that I do not believe he will ever go to prison. The hope is that when he would have exhausted everything, at that point he may be too old to jail and he will use sympathy as an excuse to keep out of prison - contrary to his assertion that we should feel sorry for the lion if we see him and a lion fighting. I have said it many times before, Panday will not see a day in jail because of his tie-up-the-courts strategy. It's a common legal tactic.

La Diva, if I understand you rightly, are you suggesting that Rowley do a Thornton? I was under the impression that Dookeran et al had already gone ahead and formed a "third viable party". There are quite a number of fringe "Parties" whose candidates generally lose their deposits at election time. The country is saturated with them. No harm in having "pressure groups" but I don't see a fourth viable party just yet. It would only lead to further vote-splitting and longevity of the present regime.

PNM corruption was unearthed and charges laid under NAR. UNC was unearthed and laid under PNM. Who is to unearth the present corruption? It took over twenty years until PNM went out of power to unearth O’Halloran and Prevatt. We hear complaints of,
1) Rowley was accused of wajank behaviour by Manning, but this behaviour was sanctioned as Rottweiler behaviour when he was attacking UNC.
2) Rowley was accused of taking material from the Scarborough Hospital by Ganga Singh. The Integrity Commission became involved and unknown to Rowley a hatchet job was being done on him. Politically Rowley was being set up to take the fall. Was this an attempt to distract from the corruption of UDECOTT?
3) Rowley took pre-emptive action and was able to defend himself and was cleared.
4) The accusations persisted.
5) The question arises was there two sets of bobol, Rowley with Elias and Manning with Hart.
6) Were they both fighting for turf? Are they now turning on each other?
7) What is the role of the other MP’s who have defended either’s action saying that there is no corruption are they implicated by their support.
8) If Rowley was not attacked would he have countered or just work in the system.
9) What was his motivation, nation defence or self preservation?
10) The same applies with RAMJACK, COP and Panday.
11) Where Ramesh’s initial charges against Panday, motivated by the fact that Panday did no support his election win.

It is not only a matter of who is guilty but is it politically convenient to go after that person. Ganga Sing and Sadiq were also suspected of being corrupt. Coke was found in Sadiq’s water tank. The UNC defended Sadiq saying that he was set up. Ganga Sing was implicated and threatened by PMN about the Desal project he bust the mark on Rowley and then he attack UNC, he was then left alone. Jack Warner was threatened by PNM about corruption in the building of the five stadia he now attacking Panday they left him alone. PNM attacked Ramesh about his possible implications in the murder of a witness, he attack Panday and he was left alone. Manning is now saying that he was involved in the plan to bring down Panday and that same plan is being used to bring down PNM. He ascribes the planner as Ramesh. 1) COP, who was financed by Sadiq, who when he did not get the person of choice asked back for his million dollars. The same Sadiq, who was investigated for his involvement in the drug trade. Sadiq who was suspected of spreading the guns in Laventille and UNC connection to the Jamat.
2) RAMJACK, Ramesh who was suspected of implications in the killing of a witness according to PNM. Jack who is suspected of corruption in the building of the five stadia according to PNM. Jack who is implicated in ticket fraud in the last WORLD CUP and many more FIFA scandals if you read Jennings book. If you don’t believe what PNM say about Jack, Ramesh or Sadiq then you cannot believe what they say about Panday.

The only fact there is that he asked back for his million dollars. As for the reason, you list no facts. The other opinions you listed represent ZERO reason for me to cross them out as an option, especially when you compare that against the flaws of the PNM and UNC. There are in fact some very serious flaws which prevent me from heading in their direction. Until I see for myself that this gets dealt with positively, I will NOT cast a vote for the COP.

There is much I dislike with PNM governance under Manning. Similarly, Basdeo Panday was never and will never be an option for me. Flawed as they both are, if I have to choose between a wasteful spender and a thief, my choice is simple. We are fortunate however that we no longer have to choose only between a wasteful spender and a thief.

We would then know if the Drug King Pins are financing our Political Parties.

Campaign Finance Reform was not one of the crucial issues during Obama's presidential campaign. Indeed, there were many who felt he flip-flopped on Campaign Finance Reform. It was addressed because he was expected to address it. The fact that his advisors were able to optimise internet technology within the confines of the law enabled Obama to obtain the millions necessary to win. The strategy of turning down all contributions from federal lobbyists and PACs, never before done, virtually guaranteed a never ending pot of gold when he picked up contributions online, all while staying within the campaign finance regulations. The issue of Campaign Finance Reform was hardly even raised when the Republicans, unable to capitalize on the internet strategy, started running out of money... as well as support. The old ways of raising money helped to sink them, but again, there was no hue and cry about Campaign Finance Reform. Obama simply took advantage of a superior strategy, and it had very little to do with CFR.

I saw on Fox that there are some legal challenges to the ELECTION FINANCE LAWS that would rebound to the benefit of the Republican Party. The strategy is akin to the Reverse Discrimination Laws, they have not succeeded but they are trying to limit any advantage that Obama was able to get. The Drug Economy in T&T has been identified in the billions, it is reasonable to assume they would want to buy influence.

If any of that ELECTION FINANCE LAWS were true they would have taken action on it.
