Erla’s lawyer questions delay in reinstatement letter

More than 24 hours af­ter she was in­formed that the Po­lice Ser­vice Com­mis­sion (PolSC) lift­ed her sus­pen­sion, Com­mis­sion­er of Po­lice Er­la Hare­wood-Christo­pher is yet to re­ceive her re­in­state­ment let­ter.

Guardian Me­dia spoke to­day with the top cop's at­tor­ney, Se­nior Coun­sel Pamela El­der, who has ques­tioned the de­lay in dis­patch­ing the let­ter.

News of Hare­wood-Christo­pher's sus­pen­sion be­ing lift­ed was raised in court af­ter Jus­tice Christo­pher Sieuc­hand dis­missed her claim that the Po­lice Ser­vice Com­mis­sion act­ed il­le­gal­ly when it sus­pend­ed her in Jan­u­ary 2025.

Guardian Me­dia at­tempt­ed to con­tact the PolSC chair­man, Dr Wen­dell Wal­lace, but the calls went unan­swered.

The com­mu­ni­ca­tions man­ag­er for the PolSC, Dale Brizan, al­so was con­tact­ed; how­ev­er, the call was dis­con­nect­ed af­ter our re­porter iden­ti­fied him­self.

Dur­ing our in­ter­view to­day with Se­nior Coun­sel El­der, she as­sert­ed there is no rea­son for the de­lay in of­fi­cial­ly lift­ing the sus­pen­sion.

“It is shock­ing. It is scan­dalous. It is de­plorable,” the se­nior at­tor­ney said. “I can’t find the words to de­scribe the con­duct of the Ser­vice Com­mis­sion in not is­su­ing this let­ter with dis­patch.”

Se­nior Coun­sel El­der says the act­ing ap­point­ment of Ju­nior Ben­jamin be­came null and void the minute the Po­lice Ser­vice Com­mis­sion de­cid­ed to lift the sus­pen­sion.

“One has to look at the nat­ur­al con­se­quences which flow from the lift­ing of the sus­pen­sion,” Pamela El­der SC points out. “This is not a com­mis­sion­er who was dis­missed and you’re look­ing to re­in­state her. This is not a com­mis­sion­er against whom dis­ci­pli­nary pro­ceed­ings were in­sti­tut­ed. This is a com­mis­sion­er whom you no­ti­fied that she had been sus­pend­ed, and her sus­pen­sion con­tin­ued un­til the ces­sa­tion of the in­ves­ti­ga­tion.”

“The in­ves­ti­ga­tion has come to an end,” the se­nior at­tor­ney said. “Why the de­lay?”

Sources with­in the ex­ec­u­tive of the Po­lice Ser­vice say Ju­nior Ben­jamin re­mains as the act­ing top cop un­til he re­ceives a let­ter from the Po­lice Ser­vice Com­mis­sion re­ject­ing his ap­point­ment.

As at mid­day, Hare­wood-Christo­pher was not at her of­fice. How­ev­er, sources say she is ex­pect­ed to show up at some point to­day.
