A High Court Judge has ordered the release of an attorney held for allegedly harbouring the man suspected of the brutal murder of 22-year-old Candace Honore.
Justice Nadia Kangaloo ordered the attorney’s release as she upheld his habeas corpus writ yesterday evening.
In the legal application, the attorney’s lawyer Bhimal Maharajh called on the T&T Police Service (TTPS) to justify his client’s protracted detention.
Justice Kangaloo noted that after the case was filed and served on Tuesday, the TTPS responded yesterday morning by stating that homicide detectives were expected to approach the Office of the Director of Public Prosecutions (DPP) for advice on possible charges for the attorney and the suspect.
She pointed out that when the case was called hours later, no update on the discussions with the DPP’s Office was provided.
“As at this time, that is at 5.24pm, there is no further indication as to the outcome of the conclusion of the investigation and this court therefore deems that the continued detention of the applicant is unlawful,” she said.
Honore, an aspiring nurse, was reported missing on July 11 after relatives after she was not heard from for several days.
Last Thursday, the Hunters Search and Rescue Team, led by Vallence Rambharat, found a suitcase in a pond in Valencia.
The suitcase was retrieved and found to contain plastic bags containing body parts.
While homicide detectives believe that the body was Honore’s, DNA testing is still expected to be performed.
The 28-year-old suspect was arrested at the lawyer’s Sangre Grande office on Saturday. His lawyer was arrested the following day.
Police believe that the suspect had been at the location since the grisly discovery was made.
Investigators have also questioned another man, who claimed he was asked to use his wheelbarrow to transport the suitcase from the suspect’s home.
The lawyer was also represented by Andre Koomalsingh.
