Cheese mak­er Star Sab­ga is now at home af­ter be­ing re­leased on house ar­rest late Mon­day night fol­low­ing the ex­piry of a tem­po­rary stay grant­ed by the High Court.

Sab­ga, 69, was de­tained un­der a Pre­ven­tive De­ten­tion Or­der (PDO) is­sued dur­ing the State of Emer­gency. She chal­lenged her con­tin­ued de­ten­tion, ar­gu­ing there was no law­ful ba­sis for her con­tin­ued de­ten­tion.

Ear­li­er on Mon­day, Jus­tice Vigel Paul up­held her con­sti­tu­tion­al claim and or­dered her re­lease on strict house ar­rest con­di­tions. He al­so grant­ed the State a six-hour stay of his rul­ing to al­low its at­tor­neys time to seek a fur­ther stay from the Court of Ap­peal.

In his rul­ing, Jus­tice Paul ques­tioned the need for Sab­ga to re­main de­tained af­ter Home­land Se­cu­ri­ty Min­is­ter Roger Alexan­der re­voked the Pre­ven­tive De­ten­tion Or­ders against busi­ness­man Do­minic Hadeed and his wife, Genevieve, last week, re­sult­ing in their re­lease.

The six-hour stay ex­pired at 11.30 pm be­fore the Court of Ap­peal could hear the State’s ap­pli­ca­tion for a fur­ther stay. As a re­sult, Sab­ga was re­leased from cus­tody and re­turned to her home, where she will re­main un­der house ar­rest sub­ject to the con­di­tions im­posed by the High Court.

The State’s ap­pli­ca­tion for a stay pend­ing its ap­peal is ex­pect­ed to be heard by the Court of Ap­peal at 3 pm.
