A woman who signed as a guarantor on a loan for an ex-boyfriend who is now in jail is being sued for $125,000 after the entire loan was not repaid.
When the matter came up yesterday before Justice Frank Seepersad, the parties were given directions regarding filing certain documents and it was adjourned to February 19.
Through his attorney Abdel Mohammed, Gerard Tang Foon filed a lawsuit against Sharmila Ramroop who owns a dental practice for breach of contract and $125,004.
In his affidavit, Tang Foon said on June 29, 2021, he entered into an Investment Agreement with Farand Deonanan, the borrower, and Ramroop as the guarantor.
He claimed they agreed that he would provide $250,000 to Deonanan for Package Taxi Ltd, for which Deonanan and Ramroop were directors.
Ramroop, he said, had offered to stand as security and indemnity for the money for the duration of the four-year agreement.
However, he said Deonanan only made part-payments totalling $124,996 but failed to repay the full amount of $250,000.
As a result of defaulting on the repayment of the balance of $125,004, he said Ramroop being the guarantor was obligated to pay him. Tang Foon stated he found out that Deonanan was sentenced to two years in jail for a fraud-related offence. He further claimed that Deonanan’s company appeared to be a shelf company.
In her defence, Ramroop who owns a dental practice, said Deonanan owned the company and though she was named a director, she had no involvement in any aspect of the business.
At the time of the transaction, she said she was in the later stages of her third trimester and was not fully aware as the pregnancy was taking a toll on her.
She said Deonanan told her that he had met Tang Foon who was interested in investing in the company, and he needed a second person to sign for the transaction to be completed.
In her affidavit, she said he told her the business was taking the money so it was the business that would pay back the money.
She said she was unaware that she was signing a document that made her a guarantor.
Ramroop said she only became aware that she signed as a guarantor when the claimant allegedly tried to force her to repay the loan. She said she never collected any money from the arrangement.
Tang Foon is being represented by attorney Abdel Mohammed while attorney Robin Ramoutar is seeking Ramroop’s interest.
